25 Business Components That Qualify for R&D Credits

The product, process, or software your team builds is the business component — the unit the IRS taxes and audits. This guide maps the 25 that qualify most often in AI and SaaS, with wage QRE bands, exclusions, and the documentation chain.

What's in this guide

25 qualifying components
Organized by §41 category: computer software, process, technique, and internal-use software — with the §41(d)(4) exclusions that screen the rest.
Wage QRE ranges by role
Illustrative low-to-high qualification bands for 14 roles — from AI / ML Engineers (70–95%) to Product Designers (10–40%) — with the substantially-all rule explained.
Audit-ready documentation chain
How repos, tickets, sprint boards, and design docs tie employees and time to named components — the same artifacts that win IRS examinations.
Six §41(d)(4) exclusions
Post-production work, adaptation, funded research, duplication, cosmetic design, and surveys — screened before a study to reduce audit exposure.

The 25 components

Organized by §41 business component type

Each component type carries different substantiation rules. Computer software and process are the most common; internal-use software must clear a three-part high-threshold-of-innovation test.

Computer Software
  • ›New software platform development
  • ›New AI / ML features
  • ›Significant enhancement of existing products
  • ›UX / product technical innovation
  • ›Mobile app development
  • ›Search & recommendation
  • ›Billing & financial systems
  • ›API platforms & dev ecosystems
  • ›Fraud detection & risk scoring
  • ›Analytics & BI platforms
  • ›Multi-tenant SaaS architecture (software portions)
  • ›Real-time data processing (software portions)
Process
  • ›Scalability & performance improvements
  • ›System architecture redesign
  • ›Integration of complex technologies
  • ›Real-time data processing
  • ›Data pipelines & ETL
  • ›Cloud infrastructure optimization
  • ›Database & data-model design
  • ›Multi-tenant SaaS architecture
  • ›Compliance & regulatory platforms
Technique
  • ›Cybersecurity & data protection
  • ›Quality assurance & technical validation
Internal-Use SoftwareMust clear the 3-part high-threshold-of-innovation test
  • ›Automation & internal platforms
  • ›Workflow automation engines
  • ›DevOps & CI/CD platforms
  • ›Internal AI & knowledge tools

Heightened standard

Internal-use software clears a higher bar

Components 9, 16, 17, and 25 — automation platforms, workflow engines, DevOps infrastructure, and internal AI tools — must pass all three prongs of the high-threshold-of-innovation test under Treas. Reg. §1.41-4(c)(6): Innovative, Significant economic risk, and Not commercially available. It's a frequent audit focus.
